These Terms of Service ("Terms") govern your use of kaosmetal.com and its services (the "Service"), operated by KaosMetal ("KaosMetal", "we", "us", "our"). By using the Service you accept these Terms. If you do not agree, do not use the Service.
1. The Service
KaosMetal is a heavy metal news site and music database. It offers band, album and artist pages, ratings and reviews from verified critics and from registered fans, news and editorial articles, a newsletter, community features, and, where announced, paid services such as a Pro subscription or merchandise.
2. Eligibility
You must be at least 16 years old to create an account. By registering you confirm that the information you provide is accurate.
3. Accounts
You are responsible for your account and for keeping your password safe. One person, one account. We may suspend or close accounts that break these Terms.
4. Your Content
You keep the rights to what you post (ratings, reviews, comments, photos, corrections). By posting, you grant KaosMetal a worldwide, non-exclusive, royalty-free licence to display, store, reproduce and adapt that content on the Service and in our own channels (including newsletters and social media), and to keep it in anonymised form after account deletion so aggregated scores stay consistent. You confirm that you have the right to post what you post.
5. Ratings and Reviews
Ratings are personal opinions. One rating per user per album. Manipulating scores (multiple accounts, coordinated voting, paid votes) is prohibited and leads to removal of the ratings and closure of the accounts involved. Critic scores are given by verified critics under editorial rules; fan scores are aggregated with a weighting method described on the Site.
6. Prohibited Conduct
- Illegal content, harassment, threats, hate speech, or content that infringes others' rights.
- Spam, advertising without permission, or automated scraping of the Service.
- Impersonating a band, label, artist or another person.
- Uploading photos or text you do not have the right to use.
- Interfering with the Service's security or operation.
7. Band and Label Claims
Bands, managers and labels may claim a profile. Claims are verified manually. You must have authority to act for the band or company you claim, and the information you add must be accurate and current. We may remove a claim at any time.
8. Paid Services
Where we offer paid services (subscriptions, merchandise, promotional placements), prices, terms and renewal rules are shown before you pay. Payments are processed by our payment provider. Refunds and cancellations are governed by our Refund & Cancellation Policy.
9. Intellectual Property
The Service, its design, editorial texts, database structure and trademarks belong to KaosMetal or its licensors. Band names, album titles, artwork and logos belong to their owners and appear for identification and commentary. Our news articles cite and link their sources.
9.1 Copyright Complaints
If you believe content on the Service infringes your copyright, send a notice through the contact form with the URL, a description of the work, your contact details and a statement of good faith. We act on valid notices promptly.
10. Disclaimers
The Service is provided "as is". The database is compiled from public sources and community contributions and may contain errors. Ratings and reviews are opinions. We do not guarantee availability, accuracy or fitness for a particular purpose. See also our Disclaimer.
11. Limitation of Liability
To the extent permitted by law, KaosMetal is not liable for indirect or consequential damages arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or, if nothing, to zero. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnification
You agree to hold KaosMetal harmless from claims arising from content you post or from your breach of these Terms.
13. Termination
You may delete your account at any time. We may suspend or terminate access for breach of these Terms. Sections 4, 9, 10, 11 and 12 survive termination.
14. Governing Law
These Terms are governed by the laws of Romania. Mandatory consumer-protection rules of your country of residence continue to apply where they are more favourable to you. EU consumers may also use the European Commission's online dispute resolution platform.
15. Changes
We may update these Terms. Material changes are announced on the Site; continued use after the change means acceptance.
